Effective legal representation for individuals with:
- Mesothelioma
- Lung Cancer
- Esophageal Cancer
- Stomach Cancer
- Colon Cancer
- Personal Injury
- Wrongful Death
- Medical Malpractice
Each year thousands of individuals are diagnosed with cancer. Many of the cancers have been directly caused by an exposure to asbestos or other cancer causing toxins. Mesothelioma is a cancer which can only be caused by an exposure to asbestos. Our law firm handles mesothelioma cases. In addition, asbestos can cause cancer of the lungs, stomach, esophagus, and colon.
There are many occupations which an individual could have had prior asbestos exposure. In fact, many of our clients have no idea when or where they were or could have been exposed to asbestos. We will personally investigate your case to determine when and where you were exposed to asbestos. We will investigate your work history as well as where you have resided in the past. Sometimes, it is very difficult to trace when and where an individual has been exposed to asbestos. Just to name a few of the occupations that have been linked to asbestos exposure are as follows:
- pipe fitter
- mechanic
- electrician
- factory worker
- power plant worker
- boiler maker
- auto plant worker
- insulation worker
- roofer
- welder
- shipyard worker
The above are just a few of the occupations in which individuals have been exposed to asbestos in the past. Exposure to asbestos may be present in many other occupations.
If you or a loved one have been diagnosed with any of these serious diseases, please contact my law firm immediately so that we can evaluate your potential case. Many individuals believe that if they smoked cigarettes during their lifetime, they do not have a potential legal claim. This is simply not true! Please contact us at the above phone number, or simply fill out the intake form on this website. I will personally contact you immediately regarding your potential case.
Our Firm does not require you to pay a lawyer's fee up front. If we take your injury or wrongful death case we will provide the resources to get copies of your medical documentation, hire expert witnesses, file your lawsuit and take depositions and other necessary steps in claiming money damages for your injuries. We earn our fee from the work we do in your case on a "contingency" basis, which means we deduct the litigation expenses and legal fees from the proceeds of the case.
Mesothelioma Wrongful Death:
A mesothelioma wrongful death occurs when a person dies from mesothelioma as the result of the negligence or misconduct of another individual, company or organization. The legal action for wrongful death belongs to the victim's surviving immediate family members, usually a spouse and/or children, and sometimes the victim's parents. Under certain circumstances, unrelated minor children living with and supported by the victim may also bring a claim for wrongful death. In order to bring a successful mesothelioma wrongful death action, the following elements must be present:
- The death of a human being from mesothelioma caused by another's negligent or intentional conduct.
- The survival of family members who are suffering the loss of financial support, love, care, comfort, supervision, guidance, household assistance and general society previously provided by the victim.
The general rule in wrongful death cases is that one is entitled to recover both economic and non-economic damages which are suffered as a result of the loss of a loved one. Economic damages in a wrongful death case include an award for the financial contributions which the victim would have made to his spouse, children and/or parents had he or she survived. It also includes the recovery for funeral services in memory of the victim and for burial costs. Non-economic damages include loss of love, society, companionship, comfort, affection, solace or moral support.
Toxic Exposure:
Due to the tremendous growth of corporate industry in the United States over the past fifty years, the number of dangerous, toxic substances in the environment has grown significantly. Some toxic substances are shown to cause substantial injury to people;such as lead-based paint (linked to brain damage, especially in children);asbestos (linked to lung cancer and restrictive lung disease);dry cleaning and other solvents (linked to brain damage and major organ damage);pesticides such as dioxin and DDT (linked to birth injuries) and toxic landfill waste (linked to leukemia).
